Obtaining a residence permit based on business investment is most suitable for those who want to establish or develop their business in the European Union, enjoying the benefits of legal residence in the EU – with all the conveniences that this brings in terms of travel. Statistics show that business investment is a less popular way to obtain a residence permit compared to buying real estate, however, there are several features that make this option a better solution for some investors.

Financial investment in local business
Over the past year, the Office of Citizenship and Migration Affairs in Latvia received 268 applications for residence permits based on investments made in local companies. The investment volume is estimated at 19.2 million euros. Qualified investors who complete a successful application receive a residence permit for an initial period of up to 5 years with the possibility of further extension.

When it comes to the amount of investment required, there are two possible options, but due to the changes in immigration laws that took place on September 1, 2014, the second option is almost impossible to implement.

a. The first option is to contribute more than 35,000 euros to the share capital of a Latvian company. However, to qualify for this smaller investment, there are additional requirements: you must invest in the share capital of a joint-stock company or a limited liability company, and this company must pay taxes of at least 40,000 euros per year.

b. The second option is to contribute 150,000 euros to the capital of a Latvian company (joint-stock company or a limited liability company). Although this option requires a larger initial investment, the advantage is that there are no requirements regarding the amount of taxes the company pays annually. The company must have at least 50 employees and an annual turnover of at least 10 million euros.

В течение прошлого года Управление по делам гражданства и миграции в Латвии получило 268 заявлений на получение вида на жительство на основании инвестиций, сделанных в местные компании. Объем инвестиций оценивается в 19,2 миллионов евро. Квалифицированные инвесторы, заполнившие успешную заявку, получают вид на жительство на начальный период до 5 лет с возможностью дальнейшего продления.

Когда дело доходит до размера требуемых инвестиций, есть два возможных варианта, но, поскольку изменения в иммиграционном законодательстве, которые произошли 1 сентября 2014 года, второй вариант практически невозможно реализовать.

а. Первый вариант – это вклад в акционерный капитал латвийской компании на сумму более 35 000 евро. Однако, чтобы претендовать на эту меньшую инвестицию, существуют дополнительные требования: вы должны инвестировать в акционерный капитал акционерного общества или общества с ограниченной ответственностью, и эта компания должна платить налоги в размере не менее 40 000 евро в год.

б. Второй вариант – внести 150 000 евро в капитал латвийской компании (акционерное общество или общество с ограниченной ответственностью). Хотя этот вариант требует больших начальных инвестиций, преимущество заключается в том, что нет никаких требований в отношении суммы налогов, которые компания платит ежегодно. Компания должна иметь не менее 50 сотрудников и иметь годовой оборот не менее 10 миллионов евро.
